Product availability is not guaranteed at the time of order. If an item becomes unavailable, we will notify you promptly. We strive to ensure accuracy of all content, including prices, descriptions, and images; however, errors may occur. We reserve the right to correct errors, cancel orders, or update content at any time prior to dispatch. We are not liable for technical issues, interruptions, or inability to access the Site.

INTELLECTUAL PROPERTY
All materials on this Site — including designs, graphics, logos, text, images, videos, and trademarks — are owned by Ioana Ciolacu and protected by intellectual property laws. Content may be used only for personal, non-commercial purposes. Any reproduction, modification, distribution, or commercial use without prior written consent is strictly prohibited.

TRADEMARKS
The Ioana Ciolacu name, logo, and associated marks are protected trademarks. Use without authorization is prohibited.

SECURITY
We implement appropriate technical and organizational measures to protect your data. However, no internet transmission can be guaranteed completely secure, and use of the Site is at your own risk except where liability cannot be excluded by law.

These Terms are governed by Romanian law. Any disputes shall fall under the exclusive jurisdiction of Romanian courts.

OVERVIEW
Products sold on ioanaciolacu.com are offered by ROMANIANFASHIONCOUNCIL SRL, registered in Romania. Sales are intended solely for end consumers. We reserve the right to refuse orders that do not comply with these Terms.

CONTRACT FORMATION
After placing an order, you will receive a confirmation email acknowledging receipt. This does not constitute acceptance. A binding contract is formed only when we send dispatch confirmation.

ORDER PROCESS
Before completing a purchase, you will be shown a summary including product details, total price, delivery costs, payment method, and withdrawal rights. By submitting the order, you agree to pay the stated price.

ORDER REFUSAL
We may refuse orders if payment authorization fails, items are unavailable, or fraud is suspected.

All products sold are authentic Ioana Ciolacu items produced in-house or by authorized partners. We do not sell defective or second-hand goods. Product images are illustrative and may differ slightly from actual items.

Prices may change without notice until order confirmation. All products include identification tags that must remain attached for returns.

Payments are processed through Shopify’s secure payment infrastructure and certified payment providers. We do not store or access card details. Payment is charged only when the order is accepted and processed for shipment. We reserve the right to suspend or cancel transactions suspected of fraud.

Shipping methods, delivery times, and costs are displayed at checkout and form part of the purchase contract. Delivery times are estimates and not guarantees. Delays caused by carriers, customs, or external factors are not our liability.

RIGHT OF WITHDRAWAL
In accordance with Directive 2011/83/EU on consumer rights, you have the right to withdraw from your purchase within fourteen (14) days from the date of delivery, without providing any reason.
To exercise your right of withdrawal, you must notify us within fourteen (14) days of delivery by sending a clear written statement to: customercare@ioanaciolacu.com

RETURN PERIOD
Once you have notified us of your withdrawal, you must ship the goods back to us within fourteen (14) days from the date of notification. Returns must be sent to:

CONDITION OF RETURNED ITEMS
Returned items must be handled only to the extent necessary to establish their nature, characteristics, and functioning.
To receive a full refund, items must:
• be unworn, unwashed, and undamaged
• show no signs of use beyond normal fitting
• have all original identification tags and/or security seals attached
• be returned with original packaging, accessories, and documentation
Items showing signs of wear, washing, fragrance, staining, alteration, seam damage, stretching, missing tags/seals, or any other condition affecting resale may be subject to a deduction reflecting diminished value, in accordance with Article 14(2) of Directive 2011/83/EU.

DIMINISHED VALUE
If returned goods show handling beyond what is necessary to assess their characteristics and functioning, you may be liable for any diminished value.
Where applicable, we will:
• inspect the returned goods upon arrival
• document their condition
• inform you of any assessment
• communicate the corresponding deduction before issuing the refund
If the diminished value renders the product unsuitable for resale, a refund may be refused.

RETURN SHIPPING COSTS
Return shipping costs are borne by the customer, unless:
• the item is defective
• the wrong item was delivered
• the item was damaged upon arrival
We recommend using a tracked shipping method. We are not responsible for returns lost in transit.

NON RETURNABLE ITEMS
The following items are excluded from the right of withdrawal where applicable under EU law:
• personalised or custom-made products
• sealed goods which are not suitable for return for health or hygiene reasons once unsealed
• gift cards
Sale items may be returned in accordance with statutory withdrawal rights unless expressly excluded under applicable law.

PROFESSIONAL OR EDITORIAL USE
Items that have been used for professional, commercial, editorial, promotional, event, styling, photography, filming, rental, or production purposes may show handling beyond what is necessary to establish their nature and functioning. Such items may be subject to a deduction reflecting diminished value or may be deemed non-returnable if no longer suitable for resale, in accordance with applicable consumer legislation.

INSPECTION AND REFUND
All returned items undergo inspection upon receipt.
If the return complies with the conditions above, refunds will be issued within fourteen (14) days from the date we receive the returned goods or proof of shipment, whichever occurs first.
Refunds include the purchase price and excluding any delivery costs originally paid (where required by law).
Refunds are processed using the original method of payment, unless otherwise agreed.

NON-COMPLIANT RETURNS
If returned goods do not comply with the above conditions:
• we will notify you in writing
• you may request that the goods be returned to you at your expense
If we do not receive instructions within fourteen (14) days from notification, the goods may be considered unclaimed and handled in accordance with applicable law.

INTERNATIONAL RETURNS (OUTSIDE THE EU)
For returns shipped from outside the European Union:
• duties and import taxes paid to local authorities are generally non-refundable by Ioana Ciolacu
• customers may be able to recover such charges directly from their local customs authority, subject to local regulations

REFUND PROCEDURE
After returned products are received and inspected, we will notify you whether the return has been accepted or if any deduction applies.

If accepted, refunds will be processed within fourteen (14) days from the date we are informed of your withdrawal. We may withhold reimbursement until we have received the goods or evidence that they have been shipped back, whichever occurs first, as permitted by law.

Refunds are issued using the original payment method used at checkout (Shopify-supported payment method), unless otherwise required by applicable law. Processing times may vary depending on your payment provider.

We process personal data in compliance with GDPR and applicable EU and Romanian legislation. We collect only information necessary to process orders, provide services, and communicate with customers. We do not sell personal data. Data may be shared with trusted service providers strictly for operational purposes.

You have the right to access, correct, delete, restrict, or transfer your data and may withdraw consent at any time by contacting us.

Invoices are issued electronically and sent via email after order confirmation. The sales contract is concluded in Bucharest, Romania, and is drafted in English.

We reserve the right to update these Terms at any time to reflect legal, operational, or commercial changes. The latest version will always be published on this page.
